1. Introduction
These Terms of Use (the "Terms") describe your rights and responsibilities regarding the Advanced Capital Management ("we", "our", "us") Acubic platform and algorithmic portfolio builder (the "Platform").
By accessing or using the Platform, you agree to these Terms and acknowledge our Privacy Policy and Cookie Policy.
2. Important Financial Disclaimers
Not Financial Advice: The Platform is a software tool intended for informational, educational, and computational purposes only. It is not, and should not be considered, comprehensive financial advice, investment advice, care, or portfolio management.
You understand and agree that ACM provides algorithmic modeling and data, and is not a registered investment advisor, broker/dealer, or fiduciary. We disclaim all liability for any trading losses or financial decisions made based on our Platform's outputs. Always seek the advice of a qualified financial advisor regarding your personal financial situation.
3. User Accounts
To use the Services, you must be 18 years of age or older. You are responsible for maintaining the confidentiality of your account credentials. You must not transfer or share your password with anyone else, and you are responsible for any activities that occur under your account.
4. Acceptable Use
You may not misuse the Platform, attempt unauthorized access, bypass quotas or security controls, scrape or resell outputs, upload unlawful content, interfere with service operation, or use the Platform for regulated financial advice to others without appropriate authorization.
5. Intellectual Property and User Data
ACM is the sole and exclusive owner of all right, title, and interest in and to the Platform and its content, features, and algorithms. No right, title, or interest is transferred to you, and we reserve all rights not expressly granted.
You retain rights in portfolio inputs and other information you provide, subject to the license needed for us to operate, secure, support, and improve the Platform as described in our Privacy Policy. You agree not to reverse-engineer, copy, scrape, or otherwise use the Platform's algorithms or data for your own commercial products without express written permission.
6. Payments, Subscriptions, Cancellation, and Refunds
Paid features may be offered through Stripe. Pricing, renewal terms, cancellation flow, trial terms, taxes, and refund rules must be shown at checkout or in the billing interface. The final subscription, auto-renewal, cancellation, and refund language requires attorney review and must match Stripe configuration.
7. Disclaimer of Warranties & Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
TO THE FULLEST EXTENT PERMITTED BY LAW, ACM WILL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM.
8. Termination and Service Changes
We may suspend or terminate access for misuse, security risk, non-payment, or violation of these Terms. We may modify or discontinue features, subject to applicable law and any commitments made in paid-plan disclosures.
9. Governing Law & Dispute Resolution
Please note that these terms may contain a mandatory arbitration provision if adopted in the final attorney-reviewed version. Governing law, venue, arbitration provider, opt-out mechanics, class-action waiver, and consumer-law exceptions require attorney review before enforcement.
